SoPlayer IPTV ("we", "our", "us") operates under the Digital Millennium Copyright Act, 17 U.S.C. § 512. If you hold a copyright and believe something reachable through the Service infringes it, this page tells you exactly where to send the notice and what it has to contain to be acted on.

It also covers the other side of the process: how someone whose material was taken down in error gets it restored, and what happens to accounts that attract notices repeatedly.

1. Where to send it

One agent receives every copyright notice under the DMCA. Send anything on this subject there rather than to general support, or it will simply be forwarded and lose a day:

Use that subject line. It is what routes a notice past the ordinary support queue and to the person who can act on it.

2. What a valid notice must contain

The six elements below are set by the statute, not by us, and a notice missing any of them is not a valid DMCA notice. Your written notice to the Designated Agent must contain all of the following elements:

  • Identification of the Copyrighted Work A description of the copyrighted work that you claim has been infringed. If multiple works are covered by a single notice, provide a representative list.
  • Identification of the Infringing Material A description of the material you claim is infringing and where it is located on the Service. Please include specific URLs or other information sufficient for us to locate the material.
  • Your Contact Information Your full name, mailing address, telephone number, and email address so that we may contact you regarding your complaint.
  • Good Faith Statement A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  • Accuracy Statement Under Penalty of Perjury A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorised to act on behalf of the copyright owner.
  • Physical or Electronic Signature A physical or electronic signature of a person authorised to act on behalf of the copyright owner whose right is allegedly infringed.

An incomplete notice may be treated as incomplete and go unanswered — not out of obstruction, but because we cannot lawfully act on it. Note also that a notice is a sworn document: section 6 below sets out what a false one exposes you to. If you are unsure, take legal advice before sending it.

3. What we do when one arrives

A complete and valid notice starts a fixed sequence:

  • We check it against the six elements above
  • Where the statute requires it, we remove or disable access to the material identified
  • Where a user posted the material, we tell them it has been taken down
  • We give them a copy of your notice, so they can counter-notify if they believe it was a mistake

4. If your material was taken down in error

Mistakes and misidentifications do happen, and the DMCA provides a route back. Send a counter-notification to the same Designated Agent at help@soplayeriptv.com. Like the notice itself, its contents are prescribed by statute. It must include:

  • Your full name, physical address, telephone number, and email address
  • Identification of the material that was removed or disabled and the location where it appeared before removal
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or in the district of New York if your address is outside the United States)
  • A statement that you will accept service of process from the party who submitted the original DMCA notice
  • Your physical or electronic signature

We pass a valid counter-notification to whoever filed the original notice. If they do not tell us within 10 to 14 business days that they have gone to court to stop the activity, the material may be restored. That waiting period is the statute's, not ours, and we cannot shorten it.

5. Accounts that attract repeated notices

We terminate the accounts of repeat infringers in appropriate circumstances — a policy the DMCA requires any service provider to have and to apply. Multiple valid notices about one user, or a reasonable belief of repeated or deliberate infringement, can end that user's access.

Whether a particular case meets that bar is our judgement to make, exercised in line with the law.

6. The cost of a false notice

Section 512(f) cuts both ways. Anyone who knowingly and materially misrepresents that something is infringing — or that it was taken down by mistake — can be made to pay the damages, costs and legal fees of the person they targeted, of the copyright owner, or of any service provider that relied on what they said.

Both a notice and a counter-notification are signed under penalty of perjury. Read what you have written before you send it.

7. Acting in good faith

We process notices and counter-notifications in good faith and follow the procedure the statute lays down. We are not liable for removing material we reasonably believed to be infringing on the strength of a valid notice, nor for leaving material up once a proper counter-notification has been made.

8. If this policy changes

This policy takes effect as posted and can be updated without notice, with any change effective from the moment it appears here. The Designated Agent address is the part most worth re-checking before you send anything.
